These Terms of Service (“Terms”) set out the agreement between you (“you”, “your”, “User”) and FolioDen Ltd (“FolioDen”, “we”, “us”, or “our”), governing your use of the FolioDen platform and its associated services (collectively, the “Platform”). Together with our Privacy Policy and Data Processing Agreement, these Terms form the entire legal agreement (the “Agreement”) between you and FolioDen.
By creating an account or using the Platform, you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree to any part of this Agreement, you should not register for an account or use the Platform.
FolioDen reserves the right to amend these Terms at any time. Updates will be posted on our website, and the “Last updated” date above will reflect the current version. Continued use of the Platform after changes are published indicates acceptance of the revised Terms.
FolioDen provides an online platform that enables professional photographers to upload, host and deliver digital content (the “Content”) such as images, galleries, and downloadable files, to clients and visitors. The Platform also allows photographers to sell digital downloads, prints, and related products through connected services and third-party partners.
Your available features depend on your active subscription plan. FolioDen may modify, expand, or discontinue features at any time for technical or operational reasons. We will provide reasonable notice of any significant service changes.
FolioDen does not moderate or verify Content uploaded by photographers or visitors. You are solely responsible for the legality, ownership, and accuracy of your uploaded material. FolioDen reserves the right to remove Content that violates these Terms or applicable law.
To use certain areas of the Platform, you must create an account and provide accurate, current information. You are responsible for maintaining the confidentiality of your login credentials and for all activity conducted under your account. FolioDen is not liable for any loss or damage resulting from your failure to keep your credentials secure.
You must notify us immediately at support@folioden.com if you suspect unauthorised use of your account. Accounts are non-transferable, and sharing access details is prohibited.
Subject to these Terms and your chosen subscription plan, FolioDen grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform solely for lawful professional photography purposes.

The Platform is provided exclusively as a professional gallery and client-delivery solution for photographers and related creative professionals. It is not intended or authorised for use as a general data storage, archival, or file-dumping service. FolioDen reserves the right to review usage patterns and, where it is reasonably determined that an account is being used primarily or substantially for non-gallery storage or bulk image hosting purposes, to suspend, restrict, or permanently terminate such account without prior notice. This measure is necessary to preserve system integrity, performance, and equitable service availability for users engaging with the Platform in accordance with its intended purpose.
FolioDen offers multiple subscription tiers. The available features, storage limits and pricing depend on your chosen plan. All payments are processed securely via third-party payment processors. FolioDen does not store or manage your payment card details.
Subscriptions renew automatically at the end of each billing period unless cancelled prior to renewal. Prices may be revised from time to time, with at least 30 days’ notice sent to your registered email address. Continued use after any price change constitutes acceptance of the new pricing.
Late or failed payments may result in account suspension or termination. Fees are non-refundable except where required by law.
Photographers may sell digital files or physical products (such as prints) through FolioDen or third-party print labs. Fulfilment, shipping, and returns for physical products are handled directly by those providers and are subject to their own terms and policies. FolioDen is not responsible for refunds or disputes arising from third-party transactions.
FolioDen may offer a free trial or limited-time promotion at its discretion. Eligibility for free trials is determined by FolioDen and may be revoked if abuse or misuse is detected. Only one free trial may be used per photographer account.
Your personal data is collected and processed in accordance with our Privacy Policy and Data Protection Agreement. By using the Platform, you consent to such processing and warrant that all data you provide is accurate and lawful.
FolioDen retains ownership of all intellectual property relating to the Platform, including its software, interface, design, and underlying technology. You retain ownership of all Content you upload to your galleries.
By uploading Content, you grant FolioDen a limited, non-exclusive licence to host, display and transmit your Content solely for the purpose of operating and marketing the Platform. You confirm that you own or have obtained all necessary rights to any Content uploaded.
You may cancel your subscription at any time through your account dashboard or by contacting support@folioden.com. Your access will continue until the end of your current billing cycle.
FolioDen may terminate or suspend accounts that breach these Terms, misuse the Platform, or fail to maintain an active subscription. Upon termination, all licences granted under these Terms will immediately cease.
To the fullest extent permitted by law, FolioDen and its directors, employees and affiliates will not be liable for any indirect, consequential, or incidental damages, including loss of profits, data, or goodwill, arising out of or related to the use or inability to use the Platform.
Our total aggregate liability under these Terms will not exceed the total amount paid by you to FolioDen in the six months preceding the claim.
You agree to indemnify and hold harmless FolioDen, its officers, and affiliates from any claim, damage or expense arising from your breach of these Terms, misuse of the Platform, or infringement of any third-party rights.
These Terms shall be governed by the laws of England and Wales. Any dispute or claim arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
